Customer Service Policy
This Customer Service Policy is an agreement upon the terms and conditions that apply to customers for purchases from Stonedeal.com (hereinafter referred to as "Stonedeal").
GENERAL INTENT: Stonedeal intends to do business in good faith and with integrity. Stonedeal strives to present the offers with the maximum transparency and accuracy. It is Stonedeal responsibility to check that the products match the description given on the site. It is Customer responsibility to assess the adequacy of the offer to his own needs. In that respect, Customer can require by writing as much complements of information as he needs till he can make a decision of purchase in total consciousness.
Customer agrees to be bound by and accepts this Agreement as applicable to Customer's purchase of product(s) from Stonedeal, and/or the Stonedeal Website hereinafter named the "Site." As a condition of sale, Customer agrees to be bound by and accepts these terms and conditions. These terms and conditions are subject to change without prior written notice at any time, in Stonedeal sole discretion. YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS OF SALE IS INCLUDED IN YOUR ACCEPTANCE OF THE TERMS AND USE OF THIS WEBSITE.
1. ORDER ACCEPTANCE: An order is placed with Stonedeal when 50% of the proforma value is deposited into Stonedeal’s account. Prior to this event, all contacts made between Stonedeal and the Customer are considered a quote. Stonedeal reserves the right to decline Customer's order for any reasonable cause including but not limited to availability of products, failure by Customer to fulfill payment terms, and/or breach by Customer of this Agreement. In the event of a typographical error or error in pricing information received from Stonedeal’s suppliers, Stonedeal shall have the right to refuse or cancel any orders placed for products listed at incorrect price.
2. ORDER PROCESSING: When Customer has approved the proforma and transferred 50% of its value, it is Customer responsibility to provide Stonedeal with adequate information regarding custom clearance Customer agent and Custom clearance requested documentation at the port of destination indicated by Customer.
3. ORDER SHIPMENT: Stonedeal is responsible for managing the filling and the loading of the containers orders. Stonedeal incoterm is C&F to stay in control of the loading and shipment process. Shipping documents will be forwarded to Customer by express courier.
4. PAYMENT TERMS 50% of the total quoted price is required as a deposit in order to proceed with the purchase. The remaining balance is due once the order is ready to be shipped. Stonedeal will provide Customer with a detailed container booking including ETD, vessel name and trip number.
5. SHIPPING Stonedeal is responsible for all costs related to shipping the order till the port specified by Customer. It is Customer's responsibility to provide contact information that allows the shipper to contact Customer when shipment is made. If Customer cannot be contacted, or is not available, to receive product; or if product is redirected upon Customer's request additional charges may be billed to Customer. Customer is responsible for checking signs of damage upon receipt of goods. All freight, loss, and damage claims must be filed with Stonedeal within ten (10) days from the date the shipment was delivered. Stonedeal shall not be liable for special or consequential damages or for any damages arising out of or caused by: (1) Delay, (2) Acts of God or the public enemy, (3) The Authority of the law, (4) Strikes, riots or quarantine, (5) The inherent nature or vice of the goods transported.
6. TITLE; RISK OF LOSS Title to product passes from Stonedeal to Customer once shipment has reached the port of destination. Loss or damage to products that occurs during shipping by a carrier selected by Stonedeal is Stonedeal’s responsibility up to limit specified by insurer.
7. WARRANTIES No warranty, expressed or implied is provided with purchases from Stonedeal.
8. LIMITATION ON DAMAGES Stonedeal does not accept liability beyond the remedies set forth herein. Stonedeal will not be liable for lost profits, loss of revenue or of business or other consequential, special, indirect, or punitive damages, even if they were foreseeable or if Stonedeal was advised of the potential of sucha damages, or for any claim by any third party except as expressly provided herein. Customer agrees that for any liability related to the purchase of products and services, Stonedeal is not liable or responsible for any amount of damages above the aggregate dollar amount paid by Customer for the purchase(s) under this agreement. This limitation will apply regardless of the form of action (i.e whether the lawsuit is in contract or in tort, including negligence).
9. RETURN AND EXCHANGE POLICY All sales are final. Stonedeal monitors product shipments and provides customer assistance in the event of carrier problems or destination errors. For inquiries regarding damaged or defective products, please contact us using the form located HERE. When unloading the container, it is the customer's responsibility to inspect the product packaging and document indisputable indication that damage to the product may have occurred in transit. Failure to do so can void damage claims.
10. CURRENCY All references to monetary amounts, including prices, on the Stonedeal’s Website (the "Site") and in this Agreement shall be either in U.S. currency or in Euros.
11. GOVERNING LAW This Agreement and any sales thereunder shall be governed by the laws of the State of Florida and the federal laws of the United States of America applicable therein, without regard to conflict of laws rules. Stonedeal and Customer exclude the application of the United Nations Convention on Contracts for the International Sale of Goods to this Agreement. The Site (excluding linked Web sites) is controlled by Stonedeal from its offices within the State of Florida, U.S.A. The Site can be accessed from any countries around the world. As each of these jurisdictions has laws that may differ from those of the State of Florida, by accessing the Site, the user agrees that all matters relating to access to, or use of, the Site, or any other hyperlinked Web site, shall be governed by the laws of the State of Florida and the federal laws of United States of America applicable therein. The user also agrees and hereby submits to the exclusive personal jurisdiction and venue of the courts of the State of Florida and acknowledges that the user does so voluntarily and is responsible for complying with local laws.
12. OTHER DOCUMENTS Other than as specifically provided in any separate formal purchase Agreement between Customer and Stonedeal, these terms and conditions may NOT be altered, supplemented, or amended by the use of any other document(s). Any attempt to alter, supplement or amend this document or to enter an order for product(s) which is subject to additional or altered terms and conditions will be null and void, unless otherwise agreed to in a written Agreement signed by both Customer and Stonedeal..
